?In late February David Swain, who ran a dive shop in Jamestown, Rhode Island, was found liable for the drowning of his wife, Shelley Tyre, during a dive off the Caribbean island of Tortola in 1999.
He was ordered to pay more than $3.5 million in punitive and compensatory damages to Tyre's parents.
Swain's appeal challenges a decision by the court judge not to allow a postponement of the hearing after one of Swain's lawyers was taken ill, nor the late appointment of another lawyer for Swain.
Swain conducted his own representation at the hearing.
