The family, residents of Beavercreek in Oregon, are suing over an incident in which Lindsey Fox, 8, had her nose amputated and suffered multiple facial lacerations.
According to a report in Oregon's Portland title Willamette Week, a lawsuit filed on 30 May in Multnomah County Circuit Court alleged that, as Fox swam in the pool at her family home on 5 July, 2006, her mask shattered due to defection.
The failure, it was said, occurred because the mask face was glass not plastic; the glass tempering was sub-standard; and the mask contained a single piece of glass rather than a double glaze.
The lawsuit named the mask maker as American Underwater Products, which trades as Oceanic Worldwide.
The suit, according to Willamette Week, seeks $750,000 for pain and suffering, plus $28,414 to cover Fox's medical expenses, which have included reconstructive surgery.
